شهدت السنوات الماضية اهتماماً بالغاً بحقوق الملكية الفكرية، خصوصا مع تزايد جرائم الانتحال والسرقة الفكرية وغيرها، وقد أدى التطور الهائل في مجال التكنولوجيا والمعلومات إلى نشوء اعتداءات وجرائم جديدة على حقوق الفرد والمجتمع، والتي ترتبط بشكل وثيق بحقوق الملكية الفكرية والإنترنت. فما حقوق الملكية الفكرية؟ وما حق المؤلف؟ وكيف يمكن حمايتها في البيئة الرقمية؟
جاء تعريف الملكية الفكرية في المنظمة العالمية للملكية الفكرية (الويبو): “تشير الملكية الفكرية إلى أعمال الفكر الإبداعية، أي الاختراعات، والمصنفات الأدبية، والفنية، والرموز، والأسماء، والصور، والنماذج، والرسوم الصناعية”. كما عُرّف حق المؤلف في المادة الأولى من نظام حقوق المؤلف السعودي بأنه: “الشخص الذي ابتكر المصنَّف”. وفي المادة الأولى من اللائحة التنفيذية لنظام حماية حقوق المؤلف: “هو كل مبدع ابتكر بجهده أيًا من المصنفات الأدبية، أو الفنية، أو العلمية، مثل: الأديب، أو الشاعر، أو الرسام، أو الموسيقي، وغير هؤلاء من الفنانين، وفقًا للقالب الذي يفرغ فيه التعبير”.
أي أن نظام حقوق المؤلف يحمي المصنفات، سواءً كانت أصلية مثل: الكتب والكتيبات، كذلك المحاضرات المطروحة، والخطب، والأناشيد، والشعر، والمؤلفات المسرحية، والتمثيلات، والاستعراضات، والرسومات، والصور الفوتوغرافية وبرمجيات الحاسب. أو كانت مصنفات مشتقة كالترجمة، والتلخيص، والموسوعات، والمختارات، وغيرها من المصنفات التي ورد ذكرها في المادتين الثانية والثالثة من نظام حقوق المؤلف. ولكن يثار تساؤل هنا: كيف تتم حمايتها في البيئات الرقمية؟ فإن بعض المؤلفين يخشون من نشر مؤلفاتهم وإتاحتها للجميع؛ بسبب سهولة الوصول إليها، والقدرة على التعدي عليها بأي صورة من صور التعدي، سواء كانت يسيرة أم فاحشة، فكيف تصدت الاتفاقيات الدولية والمنظم السعودي لمثل هذه المسألة؟
تبنت معظم تشريعات الدول العربية في قوانينها الخاصة بالملكية الفكرية، المبادئ والمعايير الدولية الكفيلة بحماية حق المؤلف، والحقوق المجاورة له في ظل التقدم الرقمي والتقني. وعلى المستوى الدولي صدرت عدة اتفاقيات تحمي حقوق الملكية الفكرية بدايةً، ثم مع التطور الرقمي السريع أجرت بعض التعديلات والإضافات لمواكبة التطورات، وحماية المصنفات الفكرية الرقمية، ومنها اتفاقية (بيرن)، وهي أول اتفاقية دولية تعنى بحماية حقوق الملكية الفكرية، والتي انضمت إليها المملكة العربية السعودية عام (2003)، كذلك اتفاقية (تريبس) للتدابير المتعلقة بأثر التجارة على حقوق الملكية الفكرية، كما أضافت تعديلات منها قواعد جديدة خاصة في مجال حماية المصنفات الرقمية، وغيرها الكثير من الاتفاقيات الدولية التي كانت المملكة العربية السعودية طرفًا فيها، وتبنتها بعض الدول في تشريعها الداخلي.
كما واعتنت هيئة الملكية الفكرية بحقوق المؤلف في المملكة العربية السعودية، وأعدت نظامًا لحماية حقوق المؤلف بمنزلة التشريع الأساسي، وأعدت لائحة تنفيذية لنظام حماية حقوق المؤلف، شارحة النظام بغرض تحديد آليات حماية حق المؤلف والمصنفات، مستندةً في ذلك عليه، كذلك نص النظام على حماية الحقوق الفكرية المبتكرة أيًا كان نوع المصنف وطريقة التعبير عنه.
سعى نظام حقوق المؤلف إلى توضيح صور التعدي ونشرها، سواءً في النظام، أو اللائحة، أو حتى في منصة تويتر عبر حساب هيئة الملكية الفكرية، حيث جاءت المخالفات في المادة الحادية والعشرين من نظام حقوق المؤلف، ومنها:
1-القيام بنشر مصنف غير مملوك لمن قام بالنشر، أو نشره مدعيًا ملكيته، أو دون الحصول على إذن كتابي أو عقد من مؤلف المصنف، أو ورثته، أو من يمثلهم.
2-تعديل محتويات المصنف، أو طبيعته، أو موضوعه، أو عنوانه، دون علم المؤلف وموافقته الخطية المسبقة على ذلك، سواء كان هذا التعديل من قبل الناشر، أو المنتج، أو الموزع، وغيرهم.
3-إزالة أي معلومة كتابية أو إلكترونية قد تتسبب في إسقاط حقوق أصحاب المصنف.
4-إزالة وفك أي معلومة احترازية إلكترونية تضمن استخدام النسخ الأصلية للمصنف، كالتشفير.
5-تصوير كتب، أو أجزاء من كتاب، دون الحصول على موافقة خطية من أصحاب الحق والجهات المعنية في الهيئة.
ومنها غير المذكور في المواد وتهتم الهيئة بها، كالرسائل النصية، فإنها محمية من النظام إذا نُشرت دون إذن صاحبها.
إن القاعدة العامة لمدة حماية حقوق المؤلف هي طيلة حياته، وبعد مماته تستمر حتى خمسين سنة، لكن لا تخلو هذه القاعدة من الاستثناءات، حيث إنه لو كان شخصًا اعتباريًا أو غير معروف (نشر باسم مستعار) فإن مدة الحماية خمسين سنة من الإصدار، وبالنسبة إلى المصنفات السمعية البصرية (السينمائية) كذلك تبلغ مدة الحماية خمسين سنة، اعتبارا من تاريخ إتاحة المصنف للجمهور (أي عرضه)، وإلا اعتبارا من تاريخ ابتكاره. وبالنسبة إلى مصنفات الفنون التطبيقية والمصنفات الفوتوغرافية، تبلغ مدة الحماية خمسا وعشرين سنة، اعتبارا من تاريخ ابتكارها، ثم تنتقل إلى الملك العام.
لكن لا تجري كافة النظم القانونية والقوانين على هذا النهج، فالقانون الفرنسي الصادر في عام (1998) يحمي قواعد البيانات، لمدة خمس عشرة سنة فقط.
أيضا، إن العقوبات الواردة في النظام تنقسم إلى عقوبات حمائية مدنية، وجزائية، والحماية الجزائية تكون إما بالإنذار، أو غرامة مالية لا تزيد عن 250 ألف ريال، أو إغلاق المنشأة المتعدية، أو التي ساهمت في الاعتداء مدة لا تزيد عن شهرين، أو مصادرة جميع نسخ المصنف، أو المواد المستخدمة في ارتكاب التعدي، أو السجن مدة لا تزيد عن ستة أشهر، وقد يتضاعف الحد الأعلى في حال العود، وأيضًا قد تتضمن العقوبة التشهير وعلى نفقة المعتدي. أما الحماية المدنية فهي متمثلة بالتعويض، والأصل أن يكون معنويًا، فإن تعذر؛ يتحول إلى تعويض مالي يقدر بحسب الضرر.
ذكر في صحيفة هيئة الملكية الفكرية عبر تويتر بأنها عقدت ورشة عمل افتراضية -بالتعاون مع شركة جوجل- الأسبوع الماضي (2021) بعنوان: “حماية حقوق الملكية الفكرية في المجال الرقمي”، إذ تهدف الورشة للتعرف على الأساليب والطرق الفنية المستخدمة في الانتهاكات الرقمية، وآليات مكافحة قرصنة البث الرقمي، وحماية حقوق الملكية الفكرية، كما وتم شرح طرق إزالة المحتويات المخالفة في جوجل لحماية حقوق الملكية الفكرية، وآلية حجب التطبيقات المنتهكة على متجر جوجل بلاي، كما ونلاحظ حجب العديد من المواقع لانتهاكها حقوق الملكية الفكرية، منها مواقع متخصصة في الكتب الإلكترونية وغيرها. وحتى الكثير من برامج التواصل الاجتماعي تعنى بالملكية الفكرية حين الموافقة على (اتفاقية/سياسة) الاستخدام، فعلى سبيل المثال: تويتر يقوم بإيقاف الحسابات المنتهكة لحقوق الملكية الفكرية. ويثار تساؤل هنا عما إذا كانت التغريدات محمية بحقوق الملكية الفكرية أم لا؟ وجاءت الإجابة في موقع الويبو: “إن طول التغريدة محدود بمئة وأربعين رمزاً، وعليه فمن غير المرجح أن تستوفي التغريدات شرط الإبداع اللازم للحصول على الحماية بموجب حق المؤلف، ولكن توجد استثناءات. ويرجى مراعاة أن الصور المدرجة في تغريداتك قد تكون محمية بموجب حق المؤلف”. لذلك تكون الحماية حسب محتوى التغريدة، حيث أشاروا بأن الصور من المؤكد محمية. ونتطلع من هيئة الملكية الفكرية عمل مشاركات أكثر مع برامج التواصل الاجتماعي، حتى تتصدى لمثل هذه الاختراقات.

In recent years, a strong interest in intellectual property rights have been shown in the digital environment, specifically with the increase in fraud, identity theft, plagiarism and so on. The massive development of technology and information has led to new violations and crimes against the rights of others and society, which are closely linked to intellectual property rights and the Internet. Therefore, what are intellectual property rights? And what is a copyright? How can they be protected in the digital environment?
The definition of intellectual property in the World Intellectual Property Organization (WIPO) states: “Intellectual property refers to works of creative thought, that is, inventions, literary and artistic works, symbols, names, images, models and industrial drawings.” Furthermore, in the first article of the Saudi copyright law, copyright is defined as: “The person who created the classifier.” On the other hand, the first article of “Implementing Regulation on Copyright Protection” defines copyright as: “Every creator who has created any of the literary, artistic, or scientific works, such as: The performer, the poet, the painter, the musician, and other artists, according to the format in which the expression is emptied.”
In other words, the copyright system protects works, whether they are original, such as: Books and pamphlets, as well as lectures, speeches, anthologies, poetry, theatre literature, representations, reviews, drawings, photographs, and computer software, or are derivatives such as translations, summaries, encyclopedias, selections, and other works mentioned in articles II and III of the copyright laws. However, a question arises here. How are they protected in digital environments? Some authors fear that their literature will be published and made available to all; Because of their easy access, and the ability to violate them in any form, whether it was a minor or major violation. How did the international conventions and Saudi Arabia’s regulator address this issue?
In their intellectual property laws, most of the legislation of the Arab States has adopted international principles and standards to protect the copyright and the rights adjacent to it under digital and technical progress. At the international level, several conventions protecting intellectual property rights were first issued, and then, with rapid digital development, some modifications and additions were made to keep pace with developments, and to protect digital intellectual property, including Berne convention, the first international convention on the protection of intellectual property rights, to which Saudi Arabia acceded in (2003), as well as the TRIPS convention on measures on the impact of trade on intellectual property rights. It also made some modifications by including new special rules to ensure the protection of digital items, and many other international conventions to which Saudi Arabia was a part of and have been adopted by some countries in their domestic legislation.
The Saudi Authority for Intellectual Property (SAIP) has also taken care of copyrights, developed a copyright protection system in accordance with the basic legislation, and prepared an implementation of the copyright protection system to define mechanisms for the protection of copyright and works based on it. Moreover, it provided the protection of innovative intellectual rights of any type and its way of expression. The copyright system sought to clarify and disseminate images of plagiarism, whether it was in the system, the regulation, or even on Twitter platform via Saudi Authority for Intellectual Property (SAIP) account.
Violations of Article 21 of the Copyright Act included:
Publication of a compilation that is not owned
claiming ownership of work with or without having a written authorization or contract of the author, his heirs, or representatives.
Modification of the contents, nature, subject matter or address of the classifier without the author’s knowledge and prior written consent, whether by the publisher, producer, distributor, etc.
Removal of any written or electronic information that may cause the termination of the authors rights of the classifier.
Removal of any electronic precautionary information that ensures the use of originals of the compiler, such as encryption. photocopy books, or parts of a book, without the written consent of the holders of the right and the concerned ones in the administration. They are protected from the system if published without the permission of the author.
The general rule for the protection duration of an author’s rights is for the rest of his life, and after his death, it lasts up to 50 years. However, there is an exception for this rule. If the author was a legal or anonymous person (published by a nickname), the protection period will be 50 years from release. For audio-visual works (Cinematography) The minimum period of protection is also 50 years, from the date of public availability (i.e. presentation), or from the date of its creation. For polytechnic and photographic works, the minimum period of protection is 25 years from the date of their creation, then it will be passed to the public property.
Nonetheless, not all legal systems and laws follow this approach. To demonstrate, the French law of 1998 protects databases for 15 years only. Also, the penalties provided in the system are divided into civil and penal. The penal protection penalties are a warning, a fine of not more than 250,000, the closure of the infringing facility, or which contributed to the assault for not more than two months, the confiscation of all copies of the classifier or materials used in the commission of the infringement, imprisonment for not more than six months, and the maximum limit in the event of recidivism may be doubled. On the other hand, civil protection is moral compensation and, if not possible, turns into damage-based financial compensation.
The Saudi Authority for Intellectual Property (SAIP) tweeted that it held a virtual workshop in collaboration with Google last week (2021), which was titled: “Protection of intellectual property rights in the digital field”, and it aimed at identifying methods and techniques used in digital violations, mechanisms to combat digital hacking, protection of intellectual property rights, ways to remove offending content in Google to protect intellectual property rights, the mechanism to block violated apps on Google Play, and the blocking of many sites for infringement of intellectual property rights, including specialized e-book sites, and even many social media programs are concerned with intellectual property when the use (convention/policy) is approved. For example, Twitter is turning off accounts that violate intellectual property rights. The question arises whether the tweets are protected by intellectual property rights or not. The answer was on the (WIBO) website: “The length of the tweet is limited to a hundred and forty symbols, thus the tweets are unlikely to meet the creative requirement for copyright protection, but there are exceptions. Please bear in mind that the images included in your tweets may be protected by copyright”. So protection is based on the content of the tweet, where they point out that the images are definitely protected. And we look forward to Saudi Authority for Intellectual Property (SAIP) doing more partnerships with social media programs, so that they can address such hacks.
